Website Terms and conditions of use

The terms of use set forth herein (hereinafter  TERMS OF USE) comprise an agreement between INSTITUTO TECNOLÓGICO Y DE ESTUDIOS SUPERIORES DE MONTERREY (hereinafter TECNOLÓGICO DE MONTERREY) and any user of the SITE, whose web address is: http://tec.mx/ (hereinafter the SITE).

Any person who uses the SITE will be a USER (hereinafter the USER) and this implies the full and unconditional observance of these TERMS OF USE. Therefore, USERS must read and carefully evaluate them in advance to ensure that they are aware that they are bound by them and any amendments each and every time they access the SITE.

If at any time the USERS do not agree fully or partially with these TERMS OF USE, they must immediately abstain from using the SITE in any of its parts or sections.

The USER agrees that in diverse parts of the SITE there may be special stipulations that, as applicable, will substitute, complement and/or modify the TERMS OF USE (hereinafter PARTICULAR CONDITIONS), and, therefore, the USERS must also read them beforehand in each case and if they do not fully or partially agree with it or them, they must abstain from using the part or the section of the SITE regulated under this or these PARTICULAR CONDITION or CONDITIONS. If the USERS use part of the SITE regulated by one or more PARTICULAR CONDITIONS, it will be understood that they agree to be bound fully and unconditionally by them.

Access and use of the site

Access to and use of the site by TECNOLÓGICO DE MONTERREY free of charge for USERS.

USERS will register on or sign up to the SITE, only when specifically required to do so.

Objective

Through the SITE, TECNOLÓGICO DE MONTERREY supplies to USERS access to diverse information provided by TECNOLÓGICO DE MONTERREY or by persons directly or indirectly linked to such information (hereinafter the CONTENT).

USERS acknowledge that use of the SITE does not give them any property rights to the site, any of its components or CONTENT.

TECNOLÓGICO DE MONTERREY reserves the right to modify at any time and without notice the presentation, configuration, information, CONTENT and, in general, any part or aspect related directly or indirectly to the SITE.

Content

Obligation to use the site and the content appropriately

The USER undertakes to use the SITE and the CONTENT in accordance with the applicable laws and the provisions of these TERMS OF USE and in observance of public order. The USER undertakes to use the SITE and any CONTENT or aspect related to the same, in a manner that does not harm the rights and interests of TECNOLÓGICO DE MONTERREY, individuals linked directly or indirectly to the same, or of third parties. The USER will use SITE and/or the CONTENT in a manner that does not totally or partially harm, render unusable, damage or diminish it in any way.

Means for obtaining content

The USER will abstain from obtaining or attempting to obtain information messages, graphics, drawings, audio and/or image files, photographs, recordings, software and, in general, any type of material accessible through the SITE or the CONTENT.

USERS can use the CONTENT and the elements found on the SITE but must only employ for this purpose the media and procedures specified and indicated therein.

Appropriate use of the content

USERS undertake to use the CONTENT and the elements used on the SITE in a diligent, appropriate and legal fashion, and in particular, undertake to abstain from: (a) using the CONTENT in a manner or for ends or purposes that are contrary to the law, public order and the provisions of TECNOLÓGICO DE MONTERREY for the use of this SITE; (b) copying, disseminating, modifying, reproducing, distributing or using in any way for or not for profit the CONTENT and the elements used on the SITE, unless they have the express, written authorization of TECNOLÓGICO DE MONTERREY; (c) altering or manipulating the brands, logotypes, advertisements, trade names and distinctive signs in general of TECNOLÓGICO DE MONTERREY, of the SITE or of the people linked directly or indirectly to  TECNOLÓGICO DE MONTERREY (unless they have its written authorization); (d) removing, circumventing or altering the CONTENT and the elements used on the SITE, as well as the technical protection devices or any mechanism or procedure established on the SITE.

TECNOLÓGICO DE MONTERREY declares that all the CONTENT and the elements used on the SITE are duly registered and protected under the corresponding authorities and laws in Mexico. The USER undertakes to respect all the Intellectual Property rights of the CONTENT and the elements used on the SITE of which TECNOLÓGICO DE MONTERREY is the owner.

Use of the site, the content and the content under the sole responsibility of the user

By the very fact of accessing the SITE, USERS acknowledge and agree that the use of the same and of the CONTENT is under their sole and strict responsibility, and, therefore, at no time and under no circumstances will TECNOLÓGICO DE MONTERREY be held responsible for any fault or problem that might arise in the computer equipment (hardware) or computer programs (software) used by the USER to access or browse any part of the SITE.

Warranty and Disclaimer

Warranty and Disclaimer for the functioning of the SITE and the CONTENT, viruses and other harmful elements. TECNOLÓGICO DE MONTERREY does not control and does not guarantee the absence of viruses in the CONTENT, nor the absence of other elements in the CONTENT that could result in alterations in the USER’s computer system (software and/or hardware) or the electronic documents and files stored on such informatics system.

Sites and content other than the SITE and the CONTENT

As a private, nonprofit, independent institution without any political or religious affiliations, TECNOLÓGICO DE MONTERREY does not permit the publication of any content that contravenes this nature and reserves the right to agree to publish or suggest sites, subsites or material that do not belong to the SITE and TECNOLÓGICO DE MONTERREY that it considers to be of interest to the USERS. If so, TECNOLÓGICO DE MONTERREY is not responsible in any form or manner for such sites and materials, or for access to or use by the USER of the same.

In addition, any site and/or subsite on the Internet, other than the SITE, can have a link or hyperlink to the SITE or CONTENT with or without the authorization of TECNOLÓGICO DE MONTERREY. TECNOLÓGICO DE MONTERREY is not responsible for the origin, uses and destinations of such links.  In the same way, the person responsible for the sites and/or subsites that mention or manage a link to the SITE and/or CONTENT, is not necessarily authorized to manage such links or to promote TECNOLÓGICO DE MONTERREY, the SITE or the CONTENT. TECNOLÓGICO DE MONTERREY does not assume any responsibility for such sites or their content other than the SITE, nor accept any advertising charges, unless it has a contract previously signed by the parties.

Denial and withdrawal of access to the site and/or content

TECNOLÓGICO DE MONTERREY reserves the right to deny or withdraw access to the SITE and/or CONTENT at any time and without prior notice, on its own initiative or at the request of any person to any USER for any reason, including, but not limited to, USERS who misuse the SITE, any of its parts or sections or CONTENT, or who totally or partially fail to fulfill these TERMS OF USE or any resulting PARTICULAR CONDITIONS.

Duration and termination

The duration of the SITE and the CONTENT is indefinite. Nevertheless, TECNOLÓGICO DE MONTERREY can terminate, suspend or discontinue, at any time and without prior notice, the SITE and/or any of the CONTENT.

Obligation to observe the Instructions

The USER undertakes to follow ad litteram any instruction given by TECNOLÓGICO DE MONTERREY or by personnel authorized by TECNOLÓGICO DE MONTERREY in relation to the SITE, regarding any mechanism or procedure stipulated for the use of the SITE and the CONTENT. The USER must only follow the instructions given by TECNOLÓGICO DE MONTERREY.

Liability for damages and losses

The USER is liable for any damages and/or loss of any kind resulting from the nonfulfillment of these TERMS OF USE or any applicable legislation, thus holding TECNOLÓGICO DE MONTERREY harmless from all civil, criminal, administrative or any other type of responsibility.

Without prejudice to the provisions of the previous paragraph, in the event that TECNOLÓGICO DE MONTERREY is sanctioned or sentenced by a competent authority in any procedure related to any civil, criminal, administrative or any other type of responsibility, it will notify the responsible USER, who must pay TECNOLÓGICO DE MONTERREY the amount that it has been sentenced to pay, as well as any costs, fees and other expenses incurred, within 15 calendar days following the notification. If the payment is not made within the specified term, the USER undertakes to pay TECNOLÓGICO DE MONTERREY an amount equivalent to the principal as a conventional penalty.

Personal Information

In order to use or enjoy any of the CONTENT, the USER must provide TECNOLÓGICO DE MONTERREY in advance with specific data of a personal nature (hereinafter PERSONAL INFORMATION) that TECNOLÓGICO DE MONTERREY may or may not manage automatically. The USER, on accessing the SITE or any of the CONTENT in which PERSONAL INFORMATION is required, is authorizing TECNOLÓGICO DE MONTERREY to conduct analyses and studies based on the same.

The USERS undertake to provide truthful, reliable PERSONAL INFORMATION and, if they do not wish to do so in the parts of the SITE where it is requested, they will abstain from using that part or those parts or sections of the SITE. If the USERS provide false or confusing information, TECNOLÓGICO DE MONTERREY can deny them access to the SITE and CONTENT therein, being held harmless from any applicable indemnifications.

By providing their PERSONAL INFORMATION on the SITE, USERS are authorizing TECNOLÓGICO DE MONTERREY to provide any competent authority with the respective information, if so requested by the appropriate legal means. TECNOLÓGICO DE MONTERREY will not share any personal information that has been supplied with third parties, unless necessary to provide a service or product required by the USER.

License

TECNOLÓGICO DE MONTERREY authorizes the USER to use the SITE exclusively under the TERMS and CONDITIONS expressed herein, without any implication that this gives the USER any license or authorization or any type of right other than the use mentioned beforehand regarding the "Intellectual Property" of TECNOLÓGICO DE MONTERREY. “Intellectual Property” is understood to mean all the brands registered and/or used in Mexico or abroad by TECNOLÓGICO DE MONTERREY, as well as full rights over inventions (patented or not), industrial designs, utility models, confidential information, brand names, advertisements, reserved rights, domain names, and all types of patrimonial rights over works and creations  protected by copyright and all other forms of industrial or intellectual property acknowledged or to be acknowledged in the corresponding laws.

Other provisions

Form. The USER agrees that a printed version of these TERMS and CONDITIONS, and of any communication sent and/or received in electronic form will be admissible as a means of proof in any legal and/or administrative proceedings.

Governing law and jurisdiction. Regarding the interpretation and compliance with the provisions set forth herein, the USERS, by the very fact of accessing the SITE, agree to be subject to the governing laws and the jurisdiction of the competent courts in Mexico, renouncing any other jurisdiction that for reasons of its present or future address or for any other reason might correspond to them.  

Ineffective provisions

If any of the TERMS and CONDITIONS set forth herein are found to be unenforceable or declared to be null and void in accordance with the applicable legislation, it will be replaced by a term or condition that is valid and that can fulfill with greater rigor the objective of the provision that is unenforceable or has been declared to be null and void. All other terms and conditions will continue to be valid.

Rights

Any right that has not been expressly conferred in this document will be understood as reserved to TECNOLÓGICO DE MONTERREY.

"In the event of a discrepancy between the content of the English version and the original Spanish version the latter shall prevail".

Personal data and sensitive personal data processed by ITESM

To fulfill the data processing purposes indicated herein, ITESM must collect and process the following categories of personal data:
- Identification data, including your personal image
- Authentication data
- Contact data
- Data related to your experience and current occupation
- Location data
- Data related to the project with which you are applying
- Data related to your economic activity, and those related to the impact of the project

Moreover, in order to fulfill the purposes indicated herein, ITESM will not collect or process any sensitive personal data. In addition, we should like to inform you that, when you participate with a team project, ITESM will process the personal data related to identification of the project coauthors, and to their roles and participation (“Third Parties”), for which you acknowledge having the consent of the aforementioned for ITESM to process their data under the terms of this Privacy Notice.

Primary purposes
ITESM will process your personal information for the following primary and necessary purposes:

When you apply to participate in the call:

Keep for a limited time a historical record of your participations in Entrepreneurship Programs. If you are a winner, to arrange your participation in the call for the National INC Prototype INCmty 2020.

When you so authorize, to use your photograph or video recording to generate any support materials we deem relevant for ITESM’s promotional and informative ends and that could be published or distributed in Mexico or abroad through print or electronic media, such as websites, social networks, brochures and/or advertisements.

To generate statistics for ITESM’s internal control processes.

• To contact you by any physical and electronic media in order to send you our own or third-party promotional information that could be of interest to you. The legitimation of the aforementioned secondary purpose is based on your consent, which means that at any time you can oppose the same or revoke your consent. If you wish to restrict or suppress the processing of your personal data for any or all of the secondary purposes, please contact us immediately by email at the following address: datospersonales@itesm.mx.

Transfers
Based on the provisions of article 37 of the LFPDPPP (Federal Law on Protection of Personal Data Held by Private Parties), ITESM can transfer your personal data without the need for your consent in the following cases:

- Controlling, subsidiary or affiliate companies under the common control of the responsible entity, or a parent company or any company from the same group as the responsible entity which operates under the same processes and internal policies.
- The competent authorities for the cases set forth in the applicable legislation, in the event that we receive a requisition for mandatory compliance.
- When necessary for maintaining or fulfilling the legal relationship between you and ITESM. ARCO rights and/or revocation of consent

You or your legal representative can exercise any of your rights of access, rectification, cancellation or opposition (hereinafter “ARCO rights”), and revoke your consent for the processing of your personal data by sending an email and following the procedure, requirements, and deadlines for the exercise of your ARCO rights and/or revocation of consent on our webpage: https://tec.mx/es/derechos-arco-yo-revocacion-del-consentimiento.

Please note that we cannot address your request or terminate use immediately in every case, since a legal obligation could be in place that requires us to continue to process your data.

Options for limiting the use or disclosure of your Personal Data You can limit the use or disclosure of your personal data in the events or activities that take place through digital tools and platforms by not activating the camera, not using your personal image on the account with which you connect, and/or not registering with your profile (depending on the platform used to holed the event or activity).

Uses several technologies to enhance the efficiency of the Platform, including your browsing experience. Cookies are small pieces of information stored on the browser used by each user that enable the server to remember specific data that can be used later on.

The personal data that can be obtained through the use of these technologies are: Identifiers, session username and passwords, region where you are located, type of browser, type of operating system, date and time of starting and finishing a session, webpages visited, searches completed, and advertising viewed.

Changes to this Privacy Notice

ITESM reserves the right, at its sole discretion, to change, modify, add or eliminate parts of this Privacy Notice at any time. As a result of legislative changes, internal policies or new requirements for the provision of offering of our services, this Privacy Notice is subject to modifications or updates.

Datos personales y datos personales sensibles tratados por el ITESM

Para cumplir con las finalidades del tratamiento señaladas en el presente Aviso de Privacidad, es necesario que el ITESM trate las siguientes categorías de datos personales:

- Datos de identificación, incluida su imagen personal;
- Datos de Autenticación;
- Datos de Contacto;
- Datos relacionados a su experiencia y ocupación actual;
- Datos de Ubicación;
- Datos relacionados con el proyecto con el que Usted se postula;
- Datos relacionados a la actividad económica que realiza, así como aquellos relacionados con el impacto del proyecto;

Asimismo, le informamos que para cumplir con las finalidades señaladas en el presente Aviso, ITESM no recabará ni tratará datos personales sensibles.

Por otro lado, le informamos que el ITESM dará tratamiento, cuando Usted participe con un proyecto de equipo, a los datos personales de: identificación de los coautores del proyecto, así como información relacionada a sus roles y participación (“Terceros”), por lo que Usted reconoce tener el consentimiento de estos para que el ITESM trate sus datos en términos del presente Aviso de Privacidad.

Finalidades primarias

El ITESM podrá tratar sus datos personales para cumplir con las siguientes finalidades primarias:

• Cuando Usted se postula para participar en la convocatoria:
  • Para atender, registrar y dar seguimiento a su solicitud de participación, así como a las solicitudes de información que realice.
  • Para validar la veracidad y calidad de la información proporcionada por usted.
  • Para dar cumplimiento y seguimiento a las bases, requisitos y procedimientos establecidos en la convocatoria.
  • Para atender, registrar y dar seguimiento a las quejas que en su caso realice.
  • Para contactarle y darle a conocer cualquier información referente al proceso de selección, así como para conocer su opinión respecto a la atención recibida y a su participación en el proceso de selección.
• Cuando Usted ha sido seleccionado como participante:
  • Para atender, registrar y dar seguimiento a las solicitudes de información que realice.
  • Para dar cumplimiento y seguimiento a las bases, requisitos y procedimientos de la convocatoria.
  • Para gestionar, en caso necesario, la elaboración y firma de los documentos descritos en la convocatoria o aquellos necesarios para la formalización de su participación.
  • Para proporcionarle y gestionar los servicios y beneficios descritos en la convocatoria.
  • Para la elaboración y entrega de la constancia que acredita su participación en la convocatoria.
  • Para contactarle y darle a conocer cualquier información referente a su participación dentro de la convocatoria, así como para conocer su opinión respecto a la atención recibida y a su participación.
  • Conservar por tiempo limitado un registro histórico de sus participaciones en Programas de Emprendimiento.
  • En caso de que sea ganador, para gestionar su participación en la Convocatoria Nacional INC Prototype de INCmty 2020.
• Cuando Usted participa en eventos y o actividades, independientemente del nombre con el que se identifiquen:
  • Para gestionar su participación.
  • Para gestionar su participación en las actividades de mentoreo y consultoría de acuerdo a su perfil.
  • Para identificarle en el entendido de que el evento o actividad podrá ser transmitida en vivo (streaming) a través de redes sociales, herramientas digitales y plataformas que así lo permitan, incluidos aquellos que permiten su reproducción posterior.
  • Para conservar la video grabación del evento como parte de las memorias de los eventos que realizamos.
  • En caso de que aplique, para la expedición de la constancia que acredite que participó.
• En caso de que aplique, para gestionar y administrar el acceso electrónico a los sistemas e infraestructura tecnológica del ITESM, así como para atender, registrar y dar seguimiento a los reportes y/o solicitudes de apoyo que realice con motivo del uso del sistema e infraestructura tecnológica.
• Para compartir su información a la entidad del Gobierno Federal, Estatal o Municipal y/o organismo intermediario, en caso de que la convocatoria, evento o actividad en el que participe reciba apoyo económico proveniente de estos para fines de comprobación del cumplimiento de las obligaciones contraídas.

Finalidades secundarias

En caso de que usted lo consienta, utilizaremos sus datos personales para las siguientes finalidades:

• Para invitarle a participar en otras convocatorias o actividades de emprendimiento.
• Para realizar reportes estadísticos, previa aplicación de un mecanismo de disociación de los datos personales.
• Para realizar estudios de investigación, previa aplicación de un mecanismo de disociación de los datos personales.
• Cuando Usted, así nos lo autoriza, para utilizar su imagen o videograbación para generar materiales de apoyo que consideremos pertinentes para los efectos promocionales e informativos del ITESM y podrán ser publicados o distribuidos en el país o en el extranjero a través de medios impresos o electrónicos, como por ejemplo: en páginas web, redes sociales, folletos y/o anuncios publicitarios.
• Realizar estadísticas con la finalidad de llevar un control interno por parte del ITESM;
• Para contactarle por cualquier medio físico y electrónico con la finalidad de enviarle información de carácter promocional propia y de terceros que pueda resultar de su interés.

Las anteriores finalidades secundarias tienen como base de legitimación su consentimiento. Lo anterior quiere decir que en cualquier momento puede oponerse a estas, o bien revocar su consentimiento.

En caso de que no desee que sus datos personales sean tratados para alguna o todas las finalidades adicionales desde este momento nos puede comunicar lo anterior al correo electrónico datospersonales@itesm.mx.

Transferencias

Con base en lo establecido en el artículo 37 de la LFPDPPP, el ITESM podrá transferir sus datos personales sin requerir de su consentimiento en los siguientes supuestos:

- A sociedades controladoras, subsidiarias o afiliadas bajo el control común del responsable, o a una sociedad matriz o cualquier sociedad del mismo grupo del responsable que opere bajo los mismos procesos y políticas internas;
- Autoridades competentes en los casos previstos por la normatividad aplicable, en el caso que recibiéramos un requerimiento de obligado cumplimiento.
- Cuando sea precisa para el mantenimiento o cumplimiento de la relación jurídica entre Usted y el ITESM.

Derechos ARCO y/o revocación del consentimiento

Usted o su representante legal podrá ejercer cualquiera de los derechos de acceso, rectificación, cancelación u oposición (en lo sucesivo “derechos arco”), así como revocar su consentimiento para el tratamiento de sus datos personales a través del correo electrónico y siguiendo el procedimiento, requisitos y plazos para el ejercicio de sus derechos ARCO y/o revocación del consentimiento de nuestra página de internet: https://tec.mx/es/derechos-arco-yo-revocacion-del-consentimiento.

Es importante que tenga en cuenta que no en todos los casos podremos atender su solicitud o concluir el uso de forma inmediata, ya que es posible que por alguna obligación legal requeríamos seguir tratando sus datos personales.

Opciones y medios para limitar el uso o divulgación de sus Datos Personales

Usted podrá limitar el uso o divulgación de sus datos personales en los eventos o actividades que se llevan a cabo a través de herramientas y plataformas digitales, no activando la cámara, no utilizando su imagen personal en la cuenta con la que se conecte y/o no registrándose con su perfil (dependerá de la plataforma que se utilice para llevar a cabo el evento o actividad).

Asimismo Usted podrá limitar el uso o divulgación de sus datos personales enviando su solicitud a datospersonales@itesm.mx.

Los requisitos para acreditar su identidad, así como procedimiento para atender su solicitud se regirán por los mismos criterios señalados en nuestra página de internet https://tec.mx/es/derechos-arco-yo-revocacion-del-consentimiento. En caso de que resulte procedente, se le registrará en el listado de exclusión propio de ITESM.

Uso de Cookies

El ITESM utiliza varias tecnologías para mejorar la eficiencia del la Plataforma incluyendo su experiencia cuando navega por el sitio. Las cookies son pequeñas cantidades de información que se almacenan en el navegador utilizado por cada usuario para que el servidor recuerde cierta información que posteriormente pueda utilizar. Esta información permite identificarle y guardar sus preferencias personales para brindarle una mejor experiencia de navegación.

• Este proceso no solo deshabilitará las cookies de nuestra Plataforma, sino las de todo su explorador.

Los datos personales que se pueden obtener a través del uso de estas tecnologías son los siguientes: Identificadores, nombre de usuario y contraseñas de una sesión; región en la que se encuentra; tipo de navegador; tipo de sistema operativo; fecha y hora del inicio y final de una sesión; páginas web visitadas; búsquedas realizadas y publicidad revisada. Estas tecnologías podrán deshabilitarse siguiendo los procedimientos del navegador de internet que utiliza.

Cambios al Aviso de Privacidad

El ITESM se reserva el derecho, bajo su exclusiva discreción, de cambiar, modificar, agregar o eliminar partes del presente Aviso de Privacidad en cualquier momento. Identity and address of the responsible entity

The entity responsible for the personal information you provide is Instituto Tecnológico y de Estudios Superiores de Monterrey (hereinafter “ITESM”), operating at the address Av. Eugenio Garza Sada Sur No. 2501, Colonia Tecnológico, Monterrey, Nuevo León, Mexico, C.P. 64700.

Personal data processed by ITESM

ITESM, in order to comply with the purposes indicated herein, will process personal identification data, personal contact data, family data, employment data, physical characteristics data, academic data, life habits and interests data, immigration data for you and your family (in the case of foreigners or to work abroad), biometric data, technical data about the device(s) of your usage to access our platforms and/or software, proprietary and/or financial data, and data related to your family members. On providing personal data related to your family members, you are acknowledging that you have their consent for ITESM to process such personal data in order to contact them and assign them as insurance beneficiaries.

In addition, we should like to inform you that if necessary, given the nature of the position, and to comply with the purposes set forth herein, the following sensitive personal data that require special protection will be processed: present//long term health and wellness information. Processing such data is necessary to comply with the obligations derived from the legal relationship between you and ITESM, which is why your consent is not required in this case.

Primary purposes

ITESM will process your personal information for the following primary and necessary purposes:

• To compile your employee record;
• To create an employee profile for managing your employment period at ITESM;
• To make a salary proposal;
• To perform medical checkups (directors only);
• To manage physical access to the ITESM facilities;
• To manage electronic access to the ITESM systems and IT infrastructure;
• To manage payroll services, including, but not limited to, salary transactions, overtime payment and other benefits;
• To do authentication and identity validation activities while using our platforms and software and to allow you the belonging access.
• To enroll you and/or your family members in life, health and any other insurance deemed necessary by ITESM, and in voluntary insurance that you request in accordance with the agreements signed by ITESM with the different insurance companies;
• To designate life insurance beneficiaries;
• For accident prevention, nutrition and psychological counseling and medical test programs;
• Provide you medical attention in case of emergency and/or if willingly asked by you in any of our medical facilities. Therefore, ITESM could handle personal data for medical record creation (physical and/or digital), according to needs, in fulfillment according the applicable sanitary normativity.
• To manage and/or operate your savings account, savings funds (including the designation of beneficiaries) and grocery vouchers;
• To provide training;
• To manage performance and personal and professional development tools;
• To create and implement analytical and statistical processes;
• To comply with the provisions of the work contract you signed with ITESM and all those that apply according to the Federal Labor Law, IMSS (Social Security Institute) and INFONAVIT (National Workers’ Housing Fund Institute), among other relevant provisions;
• To evaluate, design and award, manage, collect and procure payroll loans and other benefits in cash and in kind, financial aid, scholarships, and recreational, cultural and sports activities;
• To carry out immigration procedures and/or renew the corresponding immigration permits (for foreigners);
• For comprehensive wellbeing programs;
• To complete all the necessary separation procedures, upon termination of the labor relationship;
• And in case you request it, to issue employment certificates, even once the legal relationship with you has ended. To fulfill the previous purpose, ITESM may keep and process the personal data needed for issuing written records.
• For the investigation, management, attention and follow-up of complaints received through our complaints system that deal with conduct and may be opposite to our code of ethics written in terms established by the Work Federal Law (english for Ley Federal del Trabajo).
• Summarizing: To do all needed managing and administration activities for your job position and addtional labor benefits.
• To fulfill with our legal and current obligations when you decide to be part of magazines, books or national/international publications, which includes doing necessary spreading and disclosure activities.

In addition, ITESM will process and use the personal data of third parties indicated by you, to contact them in an emergency.

We should also like to inform you that you cannot request ITESM to cease from processing your data for the aforementioned primary and necessary purposes, since such processing is necessary to fulfill the obligations derived from the relationship between you and ITESM.

Secondary purposes

In addition, if you do not object, ITESM will process your personal information for the following additional purposes that are not necessary for the employment relationship between you and ITESM, but will enable us to offer you the best possible attention:

• To enhance and foster the best work environment and climate (such as sending out congratulations and disseminating other celebrations and special days).
• To use your personal image (photograph, video, etc.) to generate informative and promotional materials.
• Use your data to send correspondence related to ITESM publications, such as magazines, press releases and Tec Review magazine.
• For the application of surveys and evaluations to improve the quality of the products and services we offer.
• Financial campaigns sending, advertising and marketing communications, advertising and commercial prospecting of its own products and services and / or third parties, through various means of communication, both physical and electronic.
• To provide personal and work references about your performance as an employee to authorized third party companies. Even if the legal relation between ITESM and you were ended, in accordance to the applicable laws, we remind you that this consentment will be labeled as valid, even if you express your negative to this practice in an express way.
• Keep neccessary and relevant information for work references and information about work performance to third party companies authorized by you and/or for your personal interests or benefits, even if the relationship with ITESM is ended according to law.We remind you that ITESM could be able to give work references to third party companies even after the end of your work relationship with ITESM until a consentment revocation expressed by you.

To use your information to send correspondence related to ITESM publications, such as magazines and journals, newsletters and the Tec Review magazine. If you wish to restrict or suppress the processing of your personal data for any or all of the additional purposes, please contact us immediately by email at the following address: datospersonalestyc@itesm.mx.

Refusal to permit the use of your personal information for additional purposes will not constitute a reason to deny you the services requested or to terminate the relationship established with us.

Transfers

In order to fulfill the aforementioned necessary purpose(s) or any others required by law or the competent authorities, ITESM will transfer the necessary personal data to the following organizations and for the following ends:

If you do not want ITESM to provide your personal data for those transfers for which your consent is necessary, please send an email to datapersonalestyc@itesm.mx, indicating in the body of the email:

• Your full name and email address provided.
• Copy of your current official identification.
• The name of this Privacy Notice.
• The date on which you provided us with your personal data.
• The transfer(s) for which you do not want your data to be transferred.

ARCO rights and/or revocation of consent

You or your legal representative can exercise any of your rights of access, rectification, cancellation or opposition (hereinafter “ARCO rights”), and revoke your consent for the processing of your personal data by sending an email to the Talent and Culture Personal Data Protection Support Desk, at: datospersonalestyc@itesm.mx.

Your petition must be made using the ARCO Rights Application Form, which can be requested from the email address indicated in the previous paragraph. For the Talent and Culture Personal Data Protection Support Desk to follow up on your application, you or your legal representative must prove your identity for any necessary purpose, so please complete all the sections indicated on the ARCO Rights Application Form and enclose a copy of one of the current official identifications specified therein. For further information on the procedures, requirements and deadlines for the exercise of your ARCO Rights and/or revocation of consent, please contact the Talent and Culture Personal Data Protection Support Desk by email (see previous paragraph).

Limitation and/or Disclosure of your Data

You can limit the use or disclosure of your personal data by sending your request to: datospersonalestyc@itesm.mx. If your request is valid, you will be added to ITESM’s exclusion list.

Use of cookies

ITESM uses several technologies to improve the efficiency of the platform, including your user experience (when browsing the site). If considered necessary, you have the right to go to the National Institute of Transparency Access to Information and Protection of Personal Data (english for Instituto Nacional de Transparencia Acceso a la Información y Protección de Datos Personales, INAI) to assert any disagreement related with your Personal Data treatment by ITESM.

Changes to the Privacy Notice

ITESM reserves the right, in its sole discretion, to change, modify, add or delete parts of this Privacy Notice at any time. Derived from legislative changes, internal policies or new requirements for the provision or offering of our services, this Privacy Notice will be subject to modifications or updates. In such case, ITESM will publish said modifications on the website https://tec.mx/ and will indicate the date of the latest version of the notice.
