Website Terms and conditions of use

The terms of use set forth herein (hereinafter  TERMS OF USE) comprise an agreement between INSTITUTO TECNOLÓGICO Y DE ESTUDIOS SUPERIORES DE MONTERREY (hereinafter TECNOLÓGICO DE MONTERREY) and any user of the SITE, whose web address is: http://tec.mx/ (hereinafter the SITE).

Any person who uses the SITE will be a USER (hereinafter the USER) and this implies the full and unconditional observance of these TERMS OF USE. Therefore, USERS must read and carefully evaluate them in advance to ensure that they are aware that they are bound by them and any amendments each and every time they access the SITE.

If at any time the USERS do not agree fully or partially with these TERMS OF USE, they must immediately abstain from using the SITE in any of its parts or sections.

The USER agrees that in diverse parts of the SITE there may be special stipulations that, as applicable, will substitute, complement and/or modify the TERMS OF USE (hereinafter PARTICULAR CONDITIONS), and, therefore, the USERS must also read them beforehand in each case and if they do not fully or partially agree with it or them, they must abstain from using the part or the section of the SITE regulated under this or these PARTICULAR CONDITION or CONDITIONS. If the USERS use part of the SITE regulated by one or more PARTICULAR CONDITIONS, it will be understood that they agree to be bound fully and unconditionally by them.

Access and use of the site

Access to and use of the site by TECNOLÓGICO DE MONTERREY free of charge for USERS.

USERS will register on or sign up to the SITE, only when specifically required to do so.

Objective

Through the SITE, TECNOLÓGICO DE MONTERREY supplies to USERS access to diverse information provided by TECNOLÓGICO DE MONTERREY or by persons directly or indirectly linked to such information (hereinafter the CONTENT).

USERS acknowledge that use of the SITE does not give them any property rights to the site, any of its components or CONTENT.

TECNOLÓGICO DE MONTERREY reserves the right to modify at any time and without notice the presentation, configuration, information, CONTENT and, in general, any part or aspect related directly or indirectly to the SITE.

Content

Obligation to use the site and the content appropriately

The USER undertakes to use the SITE and the CONTENT in accordance with the applicable laws and the provisions of these TERMS OF USE and in observance of public order. The USER undertakes to use the SITE and any CONTENT or aspect related to the same, in a manner that does not harm the rights and interests of TECNOLÓGICO DE MONTERREY, individuals linked directly or indirectly to the same, or of third parties. The USER will use SITE and/or the CONTENT in a manner that does not totally or partially harm, render unusable, damage or diminish it in any way.

Means for obtaining content

The USER will abstain from obtaining or attempting to obtain information messages, graphics, drawings, audio and/or image files, photographs, recordings, software and, in general, any type of material accessible through the SITE or the CONTENT.

USERS can use the CONTENT and the elements found on the SITE but must only employ for this purpose the media and procedures specified and indicated therein.

Appropriate use of the content

USERS undertake to use the CONTENT and the elements used on the SITE in a diligent, appropriate and legal fashion, and in particular, undertake to abstain from: (a) using the CONTENT in a manner or for ends or purposes that are contrary to the law, public order and the provisions of TECNOLÓGICO DE MONTERREY for the use of this SITE; (b) copying, disseminating, modifying, reproducing, distributing or using in any way for or not for profit the CONTENT and the elements used on the SITE, unless they have the express, written authorization of TECNOLÓGICO DE MONTERREY; (c) altering or manipulating the brands, logotypes, advertisements, trade names and distinctive signs in general of TECNOLÓGICO DE MONTERREY, of the SITE or of the people linked directly or indirectly to  TECNOLÓGICO DE MONTERREY (unless they have its written authorization); (d) removing, circumventing or altering the CONTENT and the elements used on the SITE, as well as the technical protection devices or any mechanism or procedure established on the SITE.

TECNOLÓGICO DE MONTERREY declares that all the CONTENT and the elements used on the SITE are duly registered and protected under the corresponding authorities and laws in Mexico. The USER undertakes to respect all the Intellectual Property rights of the CONTENT and the elements used on the SITE of which TECNOLÓGICO DE MONTERREY is the owner.

Use of the site, the content and the content under the sole responsibility of the user

By the very fact of accessing the SITE, USERS acknowledge and agree that the use of the same and of the CONTENT is under their sole and strict responsibility, and, therefore, at no time and under no circumstances will TECNOLÓGICO DE MONTERREY be held responsible for any fault or problem that might arise in the computer equipment (hardware) or computer programs (software) used by the USER to access or browse any part of the SITE.

Warranty and Disclaimer

Warranty and Disclaimer for the functioning of the SITE and the CONTENT, viruses and other harmful elements. TECNOLÓGICO DE MONTERREY does not control and does not guarantee the absence of viruses in the CONTENT, nor the absence of other elements in the CONTENT that could result in alterations in the USER’s computer system (software and/or hardware) or the electronic documents and files stored on such informatics system.

Sites and content other than the SITE and the CONTENT

As a private, nonprofit, independent institution without any political or religious affiliations, TECNOLÓGICO DE MONTERREY does not permit the publication of any content that contravenes this nature and reserves the right to agree to publish or suggest sites, subsites or material that do not belong to the SITE and TECNOLÓGICO DE MONTERREY that it considers to be of interest to the USERS. If so, TECNOLÓGICO DE MONTERREY is not responsible in any form or manner for such sites and materials, or for access to or use by the USER of the same.

In addition, any site and/or subsite on the Internet, other than the SITE, can have a link or hyperlink to the SITE or CONTENT with or without the authorization of TECNOLÓGICO DE MONTERREY. TECNOLÓGICO DE MONTERREY is not responsible for the origin, uses and destinations of such links.  In the same way, the person responsible for the sites and/or subsites that mention or manage a link to the SITE and/or CONTENT, is not necessarily authorized to manage such links or to promote TECNOLÓGICO DE MONTERREY, the SITE or the CONTENT. TECNOLÓGICO DE MONTERREY does not assume any responsibility for such sites or their content other than the SITE, nor accept any advertising charges, unless it has a contract previously signed by the parties.

Denial and withdrawal of access to the site and/or content

TECNOLÓGICO DE MONTERREY reserves the right to deny or withdraw access to the SITE and/or CONTENT at any time and without prior notice, on its own initiative or at the request of any person to any USER for any reason, including, but not limited to, USERS who misuse the SITE, any of its parts or sections or CONTENT, or who totally or partially fail to fulfill these TERMS OF USE or any resulting PARTICULAR CONDITIONS.

Duration and termination

The duration of the SITE and the CONTENT is indefinite. Nevertheless, TECNOLÓGICO DE MONTERREY can terminate, suspend or discontinue, at any time and without prior notice, the SITE and/or any of the CONTENT.

Obligation to observe the Instructions

The USER undertakes to follow ad litteram any instruction given by TECNOLÓGICO DE MONTERREY or by personnel authorized by TECNOLÓGICO DE MONTERREY in relation to the SITE, regarding any mechanism or procedure stipulated for the use of the SITE and the CONTENT. The USER must only follow the instructions given by TECNOLÓGICO DE MONTERREY.

Liability for damages and losses

The USER is liable for any damages and/or loss of any kind resulting from the nonfulfillment of these TERMS OF USE or any applicable legislation, thus holding TECNOLÓGICO DE MONTERREY harmless from all civil, criminal, administrative or any other type of responsibility.

Without prejudice to the provisions of the previous paragraph, in the event that TECNOLÓGICO DE MONTERREY is sanctioned or sentenced by a competent authority in any procedure related to any civil, criminal, administrative or any other type of responsibility, it will notify the responsible USER, who must pay TECNOLÓGICO DE MONTERREY the amount that it has been sentenced to pay, as well as any costs, fees and other expenses incurred, within 15 calendar days following the notification. If the payment is not made within the specified term, the USER undertakes to pay TECNOLÓGICO DE MONTERREY an amount equivalent to the principal as a conventional penalty.

Personal Information

In order to use or enjoy any of the CONTENT, the USER must provide TECNOLÓGICO DE MONTERREY in advance with specific data of a personal nature (hereinafter PERSONAL INFORMATION) that TECNOLÓGICO DE MONTERREY may or may not manage automatically. The USER, on accessing the SITE or any of the CONTENT in which PERSONAL INFORMATION is required, is authorizing TECNOLÓGICO DE MONTERREY to conduct analyses and studies based on the same.

The USERS undertake to provide truthful, reliable PERSONAL INFORMATION and, if they do not wish to do so in the parts of the SITE where it is requested, they will abstain from using that part or those parts or sections of the SITE. If the USERS provide false or confusing information, TECNOLÓGICO DE MONTERREY can deny them access to the SITE and CONTENT therein, being held harmless from any applicable indemnifications.

By providing their PERSONAL INFORMATION on the SITE, USERS are authorizing TECNOLÓGICO DE MONTERREY to provide any competent authority with the respective information, if so requested by the appropriate legal means. TECNOLÓGICO DE MONTERREY will not share any personal information that has been supplied with third parties, unless necessary to provide a service or product required by the USER.

License

TECNOLÓGICO DE MONTERREY authorizes the USER to use the SITE exclusively under the TERMS and CONDITIONS expressed herein, without any implication that this gives the USER any license or authorization or any type of right other than the use mentioned beforehand regarding the "Intellectual Property" of TECNOLÓGICO DE MONTERREY. “Intellectual Property” is understood to mean all the brands registered and/or used in Mexico or abroad by TECNOLÓGICO DE MONTERREY, as well as full rights over inventions (patented or not), industrial designs, utility models, confidential information, brand names, advertisements, reserved rights, domain names, and all types of patrimonial rights over works and creations  protected by copyright and all other forms of industrial or intellectual property acknowledged or to be acknowledged in the corresponding laws.

Other provisions

Form. The USER agrees that a printed version of these TERMS and CONDITIONS, and of any communication sent and/or received in electronic form will be admissible as a means of proof in any legal and/or administrative proceedings.

Governing law and jurisdiction. Regarding the interpretation and compliance with the provisions set forth herein, the USERS, by the very fact of accessing the SITE, agree to be subject to the governing laws and the jurisdiction of the competent courts in Mexico, renouncing any other jurisdiction that for reasons of its present or future address or for any other reason might correspond to them.  

Ineffective provisions

If any of the TERMS and CONDITIONS set forth herein are found to be unenforceable or declared to be null and void in accordance with the applicable legislation, it will be replaced by a term or condition that is valid and that can fulfill with greater rigor the objective of the provision that is unenforceable or has been declared to be null and void. All other terms and conditions will continue to be valid.

Rights

Any right that has not been expressly conferred in this document will be understood as reserved to TECNOLÓGICO DE MONTERREY.

Términos y Condiciones de uso del PROCESO DE ADMISIÓN EN LÍNEA contenida dentro de los SERVICIOS del Aviso Legal del PORTAL DEL INSTITUTO TECNOLÓGICO Y DE ESTUDIOS SUPERIORES DE MONTERREY

1. Términos y Condiciones de Uso

Los términos y condiciones aquí contenidas, regulan el uso que el USUARIO debe darle al PROCESO DE ADMISIÓN EN LÍNEA, que se encuentran señaladas dentro de los SERVICIOS ADICIONALES en el AVISO LEGAL del PORTAL DEL INSTITUTO TECNOLOGICO Y DE ESTUDIOS SUPERIORES DE MONTERREY (entidad identificada en lo sucesivo como TECNOLÓGICO DE MONTERREY®), a través de la dirección electrónica https://solicitud.tec.mx/ (dirección electrónica identificada en adelante como “el SITIO”), especialmente para la INFORMACION DEL PROCESO DE ADMISION; regulación establecida dentro de dicho instrumento y que son aceptados por el USUARIO de manera anticipada mediante su ingreso.

En este documento se describen los componentes del acuerdo entre las partes (USUARIO y TECNOLÓGICO DE MONTERREY®) y la manera en la que se rige el acuerdo.

A menos que el USUARIO y el TECNOLÓGICO DE MONTERREY® establezcan lo contrario por escrito, el acuerdo siempre incluirá, como mínimo, los términos y condiciones estipulados en este documento, las contenidas en los términos y condiciones de cualquier aviso legal que corresponda a otros Servicios que el TECNOLÓGICO DE MONTERREY® pudiera proporcionarle (podrá leerlos en el espacio destinado para cada Servicio), así como los términos y condiciones contenidos dentro del AVISO LEGAL del PORTAL DEL TECNOLÓGICO DE MONTERREY® (siendo en su conjunto en adelante denominados como los TÉRMINOS Y CONDICIONES UNIVERSALES).

Los TÉRMINOS Y CONDICIONES UNIVERSALES, conforman un acuerdo legalmente vinculante entre el USUARIO y el TECNOLÓGICO DE MONTERREY® en relación con el uso que el USUARIO haga de los SERVICIOS.

2. Aceptación de los Términos y Condiciones

El USUARIO como primer paso, acepta los TÉRMINOS Y CONDICIONES DE USO del PROCESO DE ADMISIÓN EN LÍNEA, mediante el ingreso a la dirección electrónica del SITIO y cumplir con los requisitos de acceso y de información del SITIO, de lo contrario, no continuará haciendo uso del SITIO.

La aceptación de los TERMINOS Y CONDICIONES DE USO del SITIO para aplicar al PROCESO DE ADMISIÓN EN LÍNEA se evidenciará mediante el "click" que el USUARIO aplique en el lugar donde el TECNOLÓGICO DE MONTERREY® ofrezca esta opción en la interfaz de USUARIO del Servicio en cuestión.

3. Uso de los Servicios

A fin de poder acceder al SITIO del PROCESO DE ADMISIÓN EN LÍNEA, es necesario que se despliegue información personal, por ejemplo, datos identificativos, información de contacto, historial académico, personas relacionadas, entre otros (en adelante información personal).

Por lo anterior, el USUARIO reconoce que sabe de la existencia de un aviso de privacidad del TECNOLÓGICO DE MONTERREY®, mismo que ha podido leer y que ha comprendido, motivo por el cual autoriza desde este momento a que el TECNOLÓGICO DE MONTERREY® utilice información personal y académica que voluntariamente proporciono el USUARIO y que será desplegada en la plataforma que hospeda el PROCESO DE ADMISIÓN EN LÍNEA.

Además de dar “click” para continuar dentro del SITIO, evidenciando la autorización que se otorgó al TECNOLÓGIO DE MONTERREY® con el acceso a la dirección electrónica del SITIO y con el llenado de la información personal, el USUARIO deberá de realizar lo siguiente:

1. Crear una “cuenta nueva”, la cual le permitirá realizar el llenado del PROCESO DE ADMISIÓN EN LÍNEA.
2. Realizar el proceso de admisión en línea de acuerdo a su elección en cada variable.
3. Dar “click” para enviar el formulario debidamente llenado en el proceso de admisión al área que deberá procesar la información.

Asimismo, el USUARIO podrá retirar su solicitud de Admisión incluida en el PROCESO DE ADMISIÓN EN LÍNEA, contactando a su asesor de admisiones e indicando los motivos de la cancelación de su proceso. Su asesor le informará cuando el proceso esté realizado.

El USUARIO se compromete a no acceder ni a intentar acceder al SITIO y/o a ninguno de los Servicios por ningún otro medio (tales como medios automatizados, incluidos en éstos secuencias de comandos o rastreadores web) que no sea la interfaz provista por TECNOLÓGICO DE MONTERREY®, a menos que así se haya establecido en un acuerdo por escrito independiente entre el USUARIO y el TECNOLÓGICO DE MONTERREY®.

Asimismo, se compromete a no involucrarse en ninguna actividad que interfiera o que interrumpa el SITIO y/o los Servicios y/o los servidores y redes conectados a aquellos.

A menos que se estipule lo contrario en un acuerdo independiente entre TECNOLÓGICO DE MONTERREY® y el USUARIO, éste último se compromete a no reproducir, duplicar, copiar, vender, comercializar ni revender los Servicios y/o el Contenido del PROCESO DE ADMISIÓN EN LÍNEA para ningún fin.

4. Contraseñas y seguridad de la cuenta

Mediante la aceptación de estos términos y condiciones, el USUARIO comprende y acepta ante el TECNOLÓGICO DE MONTERREY® su obligación como único responsable, de mantener la confidencialidad de sus contraseñas asociadas a cualquiera de las cuentas que utiliza para acceder al SITIO y/o a los Servicios, así como por cada una de las actividades que se desarrollen en su cuenta.

El USUARIO deberá de notificar de inmediato al TECNOLÓGICO DE MONTERREY® de cualquier uso no autorizado del que tenga conocimiento con relación a su contraseña o cuenta para el acceso al SITIO y/o los Servicios donde se encuentra el PROCESO DE ADMISIÓN EN LÍNEA, a través de la siguiente dirección: admisiones@servicios.itesm.mx

5. Contenido del SITIO y/o los SERVICIOS

Por el presente acuerdo, el USUARIO reconoce que toda la información a la que tenga acceso como parte de los Servicios del SITIO o cualquier otro Servicio a través del uso de estos, tal y como serían archivos de datos, texto escrito, programas informáticos, música, archivos de audio u otros sonidos, fotografías, vídeos u otro material gráfico, son responsabilidad exclusiva de la persona que ha creado dicho contenido. En adelante, dicha información se denominará el "Contenido".

El “Contenido” ofrecido como parte de los SERVICIOS ADICIONALES y/o el PROCESO DE ADMISIÓN EN LÍNEA, incluidos entre otros los anuncios que aparecen en los SERVICIOS ADICIONALES, podrían estar protegido por derechos de propiedad intelectual pertenecientes a los patrocinadores o a los anunciantes que facilitan dicho Contenido al TECNOLÓGICO DE MONTERREY®, o pertenecientes a otras personas o empresas en su nombre. A menos que TECNOLÓGICO DE MONTERREY® o los propietarios del mencionado “Contenido” autoricen expresamente lo contrario en un acuerdo independiente, el USUARIO se compromete a no modificar, alquilar, arrendar, prestar, vender ni distribuir este Contenido, ni crear trabajos derivados basados en él, ya sea en su totalidad o en parte.

El USUARIO acepta que es el único responsable respecto del uso de todo el Contenido así como de aquella información que se genere, transfiera o publique durante el uso del SITIO y/o los Servicios, así como de las consecuencias derivadas de sus acciones, incluido cualquier pérdida o daño que ocasione al TECNOLÓGICO DE MONTERREY®. El USUARIO libera al TECNOLÓGICO DE MONTERREY® respecto de cualquier responsabilidad que se le pueda llegar a imputar o a cualquier tercero.

6. Derechos sobre la propiedad

El USUARIO acepta que el TECNOLÓGICO DE MONTERREY®, y/o sus proveedores de licencias, son el o los propietarios de todos los derechos, títulos e intereses asociados a al SITIO y/o los Servicios, incluidos todos los derechos sobre la propiedad intelectual que actúen sobre ellos, independientemente de si los mencionados derechos están registrados o no y de donde existan. Asimismo, reconoce que el SITIO y/o los Servicios pueden contener información considerada confidencial por el TECNOLÓGICO DE MONTERREY® y se compromete a no revelar dicha información sin el consentimiento previo y por escrito de TECNOLÓGICO DE MONTERREY®.

A menos que acuerde lo contrario por escrito con TECNOLÓGICO DE MONTERREY®, ninguna de las disposiciones de los TÉRMINOS Y CONDICIONES DE USO del SITIO y/o los Servicios, le otorga al USUARIO el derecho a usar los nombres y las marcas comerciales del TECNOLÓGICO DE MONTERREY®, sus marcas de servicio, logotipos, nombres de dominio, nombres o avisos comerciales o cualquiera otra característica distintiva de la marca.

7. EXCLUSIÓN DE RESPONSABILIDAD

El USUARIO acepta expresamente que el uso del SITIO y/o los SERVICIOS se realizan bajo su propia responsabilidad y que el Servicio se suministra "Tal Cual" y en función de su "Disponibilidad".

Por tal motivo, el TECNOLÓGICO DE MONTERREY®, sus líneas de operación, sus subsidiarias y filiales, y sus proveedores de licencias no garantizan que:

(A) El uso que el USUARIO haga del SITIO y/o los servicios, se ajuste a sus necesidades específicas.
(B) Los servicios se proporcionen de forma ininterrumpida, precisa, segura o sin errores.
(C) La información que obtenga como consecuencia del uso de los servicios sea exacta o fiable.
(D) Se corrijan los defectos de funcionamiento y operatividad de cualquier software, aplicación y/o programa que se proporcione como parte de los servicios.

Todo material descargado u obtenido por cualquier otro medio a través del uso del SITIO y/o los servicios corre a cuenta y riesgo del USUARIO y éste asumirá responsablemente  cualquier afectación o daño ocasionado en su sistema informático o en cualquier otro dispositivo, así como de la pérdida de datos, que pueda resultar de la descarga de dicho material.

Ningún tipo de notificación ni información, ya sea oral o escrita, obtenida por el usuario del sitio del Tecnológico de Monterrey® y/o de los servicios, o mediante estos últimos, originará garantías no mencionadas expresamente en los presentes términos y condiciones.

8. LIMITACIÓN DE RESPONSABILIDADES

El Tecnológico de Monterrey®, sus líneas de operación, subsidiarias y filiales y sus proveedores de licencias, no serán responsables ante el USUARIO por:

(A) Ningún daño directo, indirecto, fortuito, especial, derivado ni ejemplar en que el usuario haya incurrido, sea cual sea su causa y bajo ninguna teoría de responsabilidad. ello incluye, entre otras, cualquier pérdida de beneficios, ya sea directa o indirecta, cualquier pérdida de prestigio o reputación que pueda sufrir el usuario, cualquier pérdida de datos responsabilidad del usuario u otras pérdidas intangibles.

(B) Ninguna pérdida o daño que el USUARIO sufra o genere, incluidos entre otros pérdidas o daños originados como consecuencia de:

(I) la confianza depositada por su parte en la exhaustividad, precisión o existencia de publicidad o como consecuencia de cualquier relación o transacción entre el usuario y otro anunciante o patrocinador cuya publicidad aparezca en el sitio y/o los servicios;

(II) los cambios que Tecnológico de Monterrey® pueda incorporar en el sitio y/o los servicios o la interrupción temporal o definitiva de estos o de alguna de sus funciones;

(III) la eliminación o daño del contenido y de otros datos de divulgación que se alojan en el sitio y/o los servicios o se ofrecen a través de estos, así como la imposibilidad de almacenarlos;

(IV) la imposibilidad de proporcionar al Tecnológico de Monterrey® información precisa de la cuenta;

(V) la negligencia por no haber preservado su contraseña o la información de su cuenta de forma segura y confidencial.

9. Otros contenidos

El SITIO y/o los Servicios podrán incluir hipervínculos a otros sitios, contenidos o recursos de Internet. TECNOLÓGICO DE MONTERREY® no ejerce ningún control sobre los recursos y sitios web que proporcionen terceros ajenos al TECNOLÓGICO DE MONTERREY®.

El USUARIO reconoce y acepta que el TECNOLÓGICO DE MONTERREY® no se responsabiliza de la disponibilidad de dichos sitios web o recursos externos y que no respalda la publicidad, productos u otros materiales proporcionados en los sitios web o recursos en cuestión o a través de ellos, ni es responsable de los mismos.

El USUARIO reconoce y acepta que el TECNOLÓGICO DE MONTERREY® no se responsabiliza de ninguna de las pérdidas o daños en que el USUARIO pueda incurrir como consecuencia de la disponibilidad de dichos sitios web o recursos externos o como consecuencia de la confianza que el USUARIO deposite en la exhaustividad, precisión o existencia de publicidad, productos u otros materiales proporcionados en los sitios web o recursos en cuestión o a través de ellos.
 

10. Cambios en los Términos y Condiciones

El TECNOLÓGICO DE MONTERREY® podrá incorporar cambios en los Términos y Condiciones universales según considere oportuno. En ese caso, TECNOLÓGICO DE MONTERREY® incluirá la nueva versión de los Términos y Condiciones universales y proporcionará los Términos y Condiciones adicionales en el SITIO y/o los Servicios correspondientes o a través de estos.

El USUARIO reconoce y acepta los cambios en el SITIO y/o los Servicios después de haberse incorporado los cambios pertinentes en los Términos y Condiciones universales y Términos y Condiciones adicionales del SITIO y/o de los Servicios, a partir de su uso.

11. Términos y Condiciones legales generales

En ocasiones, es posible que, como consecuencia del uso del SITIO y/o de los Servicios o de acciones realizadas a través de estos, el USUARIO utilice un Servicio, descargue un programa o adquiera productos proporcionados por otra persona o empresa. El uso que haga de todos ellos estará sujeto a otros términos y condiciones establecidos entre la persona o empresa en cuestión y el USUARIO. En ese caso, los Términos y Condiciones no afectarán a la relación legal que establezca con estas otras personas o empresas.

Los presentes Términos y Condiciones constituyen el acuerdo legal completo entre TECNOLÓGICO DE MONTERREY® y el USUARIO; rigen el uso que el USUARIO haga del SITIO y/o de los Servicios, sin incluir los servicios que el TECNOLÓGICO DE MONTERREY® le ofrezca en virtud de cualquier acuerdo por escrito independiente, y sustituyen cualquier acuerdo previo adquirido de forma electrónica a través del SITIO, entre TECNOLÓGICO DE MONTERREY® y el USUARIO.

El USUARIO acepta que el TECNOLÓGICO DE MONTERREY® puede proporcionarle avisos, incluidos los relativos a los cambios de los Términos y Condiciones, a través del correo electrónico, correo postal o mediante su publicación en los Servicios.

El USUARIO acepta que, si el TECNOLÓGICO DE MONTERREY® no ejerce ningún derecho ni realiza ningún reclamo derivado de un agravio, se interpretará como que ello no supone una renuncia legal de los derechos del TECNOLÓGICO DE MONTERREY® y que el TECNOLÓGICO DE MONTERREY® mantendrá la posibilidad de realizar los reclamos apropiados y/o hacer valer judicialmente sus derechos.

Si un tribunal, con la jurisdicción competente para decidir sobre este asunto, falla que alguna de las disposiciones de estos Términos y Condiciones no es válida, dicha disposición se eliminará sin que ello afecte al resto. El resto de los Términos y Condiciones seguirán siendo válidas y vigentes.

El USUARIO reconoce y acepta que cada uno de las líneas de operación, subsidiarias y/o filiales del TECNOLÓGICO DE MONTERREY® pueden constituirse como beneficiarios terceros de los Términos y Condiciones y que dichas empresas están autorizadas a aplicar directamente las disposiciones de los Términos y Condiciones que les concedan los beneficios o derechos pertinentes, así como a basarse en ellas. Excepto lo anteriormente estipulado, no habrá ninguna otra persona o empresa beneficiaria de los presentes Términos y Condiciones.

Los Términos y Condiciones de servicio y la relación surgida entre el TECNOLÓGICO DE MONTERREY® y el USUARIO por virtud de estas, se regirán por las leyes de México, sin contemplarse sus normas respecto a conflicto de leyes. El TECNOLÓGICO DE MONTERREY® y el USUARIO aceptan someterse a la jurisdicción exclusiva de los tribunales de la ciudad de Monterrey, N.L para resolver cualquier asunto legal derivado de estos Términos y Condiciones. Sin perjuicio de lo dispuesto, el USUARIO acepta que el TECNOLÓGICO DE MONTERREY® podrá reclamar por desagravio provisional, o un tipo de desagravio legal urgente que sea equivalente, en cualquier jurisdicción.
