Identity and address of the responsible entity

The entity responsible for the personal information you provide is Instituto Tecnológico y de Estudios Superiores de Monterrey (hereinafter “ITESM”), operating at the address Av. Eugenio Garza Sada Sur No. 2501, Colonia Tecnológico, Monterrey, Nuevo León, Mexico, C.P. 64700.

Personal data and sensitive personal data processed by ITESM

To comply with the purposes of the treatment indicated in this privacy notice, ITESM will process the following categories of personal data:

  • Identification data (including your personal image);
  • Contact data;
  • Authentication data;
  • Data related to your academic background;
  • Bank details;
  • Data related to your interests and aptitudes both academic and vocational that you provide directly or through the performance of activities by ITESM and/or that can be inferred from information in ITESM's possession through the application of various data analysis techniques;
  • Technical data about the device(s) you use to access our platforms and/or technological tools;
  • Data about physical and biometric characteristics;
  • Data related to any disability (sensitive data).

Likewise, we inform you that in order to comply with the purposes stated in this Privacy Notice, data related to any disability (sensitive personal data) will be used so that ITESM can facilitate the use of the technologies used for your participation in the program. Likewise, personal data related to physical and biometric characteristics that we may process will be used for the purpose of recording evidence of your participation in the program. In this regard, we inform you that the processing of such data is necessary to comply with the obligations arising from the legal relationship between you and ITESM, which is why your consent is exempted.

On the other hand, in certain cases ITESM may process personal banking data related to your relatives and/or third parties who exercise your parental authority or who provide you with financial support ("Third Parties"). By providing the personal data related to your family members you acknowledge having their consent for ITESM to process their data for the debit and/or payment (as the case may be) of the service object of SoyTutor program.

Primary purposes

ITESM will process your personal information for the following primary and necessary purposes:

  • To identify you as a participant (tutor and/or student, as applicable), of the ITESM SoyTutor Program and verify that you have the necessary skills, aptitudes and other requirements for admission to the SoyTutor Program;
  • To manage the application(s) you make in connection with the ITESM SoyTutor Program;
  • To validate the veracity and quality of the information provided by you or that which may be inferred from you or obtained from other lawful sources to which ITESM may have access, including the verification of your data before government agencies or third parties with which we have entered into collaboration agreements;
  • For the evaluation, improvement, administration, procurement and granting of all the services that ITESM offers (including the design and development of new services) and to carry out all the activities that are necessary for the development of the Program and contribute to its integral formation;
  • To carry out information and data analysis activities related to your person through the application of various data analysis techniques and technologies that will allow us to better understand your profile, skills and interests;
  • To comply with and follow up on institutional procedures and activities provided for in applicable internal guidelines, procedures, regulations, standards, codes or policies;
  • To invite you and, if applicable, manage your access and participation in the activity(ies) and events related to the SoyTutor Program;
  • To comply with and follow up on the bases, requirements and procedures for registration, admission and development of the SoyTutor Program;
  • To generate the monetary withholding and payment of the consideration object of the Program, if applicable;
  • To credit you with social service or scholarship service hours, if applicable;
  • To attend, register and follow up on complaints, if applicable;
  • To generate, when applicable, the access credentials to the platform and/or the media that ITESM enables to develop the content of the SoyTutor Program;
  • To send you communications, notifications and personal notices through different channels and technological communication mechanisms that ITESM considers pertinent in order to let you know relevant information about the status of your admission process to the program or any matter that may be of interest to you; as well as to know your opinion regarding the attention received and the services we offer;
  • To make statistics and reports for internal control;
  • To record your participation in the program and/or tutoring sessions through an access history and audio, visual or a combination of both of your partitions;
  • To evaluate your performance as a tutor and/or student, as the case may be;
  • To comply with the obligations set forth in the applicable regulations.

We should also like to inform you that you cannot request ITESM to cease from processing your data for the aforementioned primary and necessary purposes, since such processing is necessary to fulfill the obligations derived from the relationship between you and ITESM.

Secondary Purposes

In addition, ITESM will use your personal information for the following purposes that are not necessary for the requested service, but will enable us to offer you the best possible attention:

  • For further contact;
  • To send you information that we believe may be of interest to you and that may be related to the products and services we offer;
  • To send you invitations to events, activities, programs and projects;
  • To promote academic life, research, outreach, cultural, recreational and social sporting events;
  • For the application of surveys and evaluations to improve the quality of the products and services we offer;
  • To send you advertising and communications for marketing or tele-marketing purposes or financial campaigns;
  • To use your personal image (whether in photographic, video, or any other similar media) to make internal and external publications about your participation in events, programs or activities, as well as to promote ITESM.
  • To produce diffusion material in physical and digital media property of ITESM and/or third parties with whom we have entered into legal agreements.
  • To use your personal image in different diffusion channels, including digital platforms and social networks for the purpose of spreading the activities of Soy Tutor program.

If you do not want ITESM to process your personal data for any of the purposes described in this section, please send an email to datospersonales@itesm.mx. You may change your option at any time, following the procedure, requirements and deadlines for the exercise of your ARCO Rights and/or revocation of consent on our website https://tec.mx/es/derechos-arco-yo-revocacion-del-consentimiento.

It is important that you keep in mind that, in case of granting your consent, it will remain valid even when the legal relationship between you and ITESM has ended, which means that ITESM may continue to process your personal data necessary to fulfill the present secondary purposes.

Transfers

According to Article 37 of the Federal Law for the Protection of Personal Data in Possession of Individuals, ITESM may transfer your personal data without requiring your consent in the following cases:

  • To controlling companies, subsidiaries or affiliates under the common control of ITESM, or to a parent company or any company of the same group of the responsible party that operates under the same internal processes and policies;
  • Competent authorities in the cases provided for by the applicable regulations, in the event that we receive a mandatory requirement;
  • When it is necessary for the maintenance or fulfillment of the legal relationship between you and ITESM, such as in the case of individuals or legal entities, national or international with which we have entered into binding legal agreements.

ARCO rights and/or revocation of consent

You or your legal representative can exercise any of your rights of access, rectification, cancellation or opposition (hereinafter “ARCO rights”), and revoke your consent for the processing of your personal data by sending an email and following the procedures, requirements and deadlines for the exercise of your ARCO rights and/or revocation of consent of our website https://tec.mx/en/arco-rights-andor-revocation-consent.

Please note that it is not always possible for us to comply with your request or to terminate use immediately, as we may be required by law to continue processing your personal data.

Limitation and/or Disclosure of your Data

Overview

Professor Allan Tucker is Chief Engineer and owner of TuckerSound at Foothill Digital, a Grammy-winning and Apple-certified boutique music mastering and audio restoration facility in New York and Monterrey. He is also an Adjunct Professor in Music Technology at the New York University Steinhardt School, collaborating in the areas of music technology and audio mastering, as well as a recording design consultant and advisor.

He is an advisor and past chair of the Audio Engineering Society (AES - New York) and has been recognized by the AES for his pioneering work in music restoration and noise abatement. He is a voting member of the Recording Academy (NARAS), the Grammy Award organization. Professor Tucker also holds the title of Dean of Education at software developer Sonic Studio LLC in California, USA.

Professor Tucker is a mastering and recording studio engineer and a world-renowned speaker and program lead designer. He has over 50 years of experience in music production, has recorded and mastered more than 3,500 records, and his work has won multiple of the most relevant awards in his profession, including Grammy Awards, Gold Record, and Record of the Year.

Professor Allan Tucker is Distinguished Professor in Music Technology for the School of Humanities and Education.
